General Conditions of Sale

1. Subject Matter and Scope

These General Conditions of Sale (GCS) govern all bookings made with the establishment Au Pré Verger, for the rental of the gîte or bed and breakfast accommodation located at 294 chemin de la Font Devay, 69210 L'Arbresle. Any booking constitutes full and unconditional acceptance of these GCS.

3. Description of Accommodations

The accommodations offered are a gîte and bed and breakfast room located in a natural setting in L'Arbresle. The capacity, available equipment, and rates are specified at the time of booking. The photographs presented on the website are provided for illustrative purposes and are not contractual.

4. Booking

The booking is considered firm and final upon receipt of the deposit payment and written confirmation from the owner. The tenant agrees to provide accurate information at the time of booking (name, first name, number of people, stay dates). Any false declaration engages the liability of the tenant.

5. Prices and Payment Methods

Prices are indicated in euros, inclusive of all taxes. They include the accommodation, bed linen, and end-of-stay cleaning, unless otherwise stated.

Accepted payment methods are:

  • Bank transfer
  • Cheque payable to Didier Barbaud
  • Cash (within the legal limit in force)

6. Deposit and Balance

  • Deposit: a deposit of 30% of the total amount is required at booking to confirm the stay.
  • Balance: the balance (70%) is paid directly on site, at the end of the stay.

7. Cancellation Conditions

  • Cancellation more than 48 hours before arrival: full refund of the deposit.
  • Cancellation less than 48 hours before arrival: the deposit is retained as compensation.
  • In case of cancellation by the owner (except in cases of force majeure), the tenant will be fully refunded the amounts paid.

8. Tourist Tax

In accordance with current regulations, a tourist tax may be collected from tenants. Its amount, set by the municipality of L'Arbresle, is indicated at the time of booking and is added to the price of the stay.

9. Security Deposit

A security deposit is required upon arrival. It is returned within 7 days after departure, minus any costs related to damage, excessive dirt, or missing items identified during the check-out inventory.

10. House Rules

The tenant agrees to comply with the house rules provided at the time of booking and available in the accommodations. These rules specify in particular the check-in and check-out times, noise rules, use of equipment, and safety instructions. They form an integral part of the rental contract. All stay rules are also available in our Terms of Use.

11. Responsibilities

The owner undertakes to provide accommodation that meets the description given at the time of booking, clean and in good working order.

The tenant is responsible for any damage caused to the accommodation or its equipment during the stay. The owner declines all liability for losses, thefts, or damage affecting tenants' personal belongings.

12. Insurance

The tenant is advised to check that their home contents insurance covers damage that may occur in the context of a holiday rental (water damage, fire, broken glass, owner's recourse). Cancellation insurance is also recommended.

13. Disputes and Mediation

In the event of a dispute, the tenant is invited to contact the owner first at contact@aupreverger.fr in order to seek an amicable resolution. In the absence of a resolution, the tenant may freely use a consumer mediator in accordance with Article L. 612-1 of the French Consumer Code.

14. Applicable Law

These GCS are governed by French law. Any dispute relating to their interpretation or execution falls under the jurisdiction of the French courts.
